Terms and Conditions

These terms and conditions apply to all purchases made from BBQKees Electronics B.V. the Netherlands. A purchase may be done via the webshop, via email, mail order, or in person. These purchases cover all sales to private persons and all legal or governmental entities that make a purchase.
BBQKees Electronics B.V. may also be referred to as ‘BBQKees’ or ‘BBQKees Electronics’ in this document.

General disclaimer

All products are sold as hobby products for home use only. Although they can be used for other purposes when in capable hands, they are not intended for industrial use or other production environments.
The EMS Gateway devices provide a link between the EMS heat source (plus the other connected EMS devices thereof) and a home automation system. They do not intend or claim to provide any control mechanism or strategy by themselves.
The products are designed to augment a heating system, and not intended to replace a critical system component like a thermostat.
Always make sure your heating system can control itself without the use of the BBQKees EMS bus product. Your home automation will fail at some point, make sure in that case your heating will not fail. It is your own responsibility. Damaging an EMS heat source or other equipment/house/environment/persons does not fall under the product warranty and is again your own responsibility, not ours. We cannot be held liable for such damages.
Heating and other control strategies implemented by yourself are also outside the scope of warranty and liability.
For instance if you use a BBQKees product to control the heat source based on dynamic energy pricing or excess solar power, we cannot held reliable for any loss of this energy, difference in price structure or lost energy savings.

Some parameters in the heat source may be stored in a memory that has a finite amount of write actions. It is your own responsibility to prevent too many write actions to these types of memory.
Also connecting a BBQKees Electronics product must be done properly and while taking into account local regulations. If you do not know how to connect a product, let a professional installer do it for you.

We cannot guarantee that any of our products will work in your specific situation or use case.

The amount of parameters you can read or write are dependent on the version of EMS-ESP firmware and the brand, model, year and software version of your specific boiler/heatpump/thermostat/etc. Some EMS devices do not respond to certain write or read commands. Because there are hundreds of different possible combinations out there, I cannot list them all or know which one will work or won’t work in your specific situation.

In some very specific situations with combinations including EMS devices, EMS Gateways and specific EMS-ESP firmware the heat source may throw an error at an undetermined time. Please disconnect the EMS Gateway and contact us to see if we can do anything to prevent or solve the error. Incorrect wiring may also give bus errors on the heat source. Always make sure you can physically disconnect the Gateway from the heat source in any error event. It is your responsibility to disconnect or power down/ power cycle the system etc in order to reset the error or prevent the system from f.i. freezing.

Hardware disclaimer and compliance

CE RoHS compliant logoAll BBQKees electronics products are properly engineered consumer market devices. They are CE certified, are manufactured according to the RoHS directive (which is part of being able to bear the CE mark), and covered by a no-nonsense two year warranty.
The CE mark is valid in the whole European Union, and Iceland, Liechtenstein, Norway, Switzerland and Turkey.
For the UK the CE marking will remain valid indefinitely so an additional UKCA test or marking is not necessary, therefore the BBQKees products can be sold safely in the UK.
For territories outside of the ones mentioned above you can still acquire BBQKees Electronics products with the valid CE mark, but some countries like the USA have their own certification process (F.i. FCC). If you order a product from us to such an overseas destination, the import and use is at your risk. Of course the product will work as intended and advertised. The Bosch boilers with EMS bus in the USA and f.i. Australia work exactly the same as here.
Please be advised that for some countries other channels on WiFi are used than in Europe. if you order a product for use outside of the general CE area, you may want to source your own power supply locally, which then has the right power plug and the correct certifications for your area.


All Gateways are tested in receive and transmit mode on an actual EMS boiler with the standard EMS bus protocol before shipment.
Although much thought went into fool-proofing the hardware design, there are always ‘better’ idiots. If your purchased BBQKees product does not work, be assured it has been tested and verified here so there is more likely a problem on your side.
If you do think the board or product itself is defective, please send us an email so we can see if we can solve it.

Do not use Ethernet models together with active POE solutions, non-isolated POE or power supplies or any other high voltage input.

Although the EMS-ESP firmware makes it possible to use free GPIO pins of the ESP32 microcontroller, you are NOT allowed to open the Gateway and add your own electronics to the GPIO pins as the Gateway was not designed to support these features. Doing so will void the warranty. Adding your own modifications may cause the BBQKees product to go ‘out of spec’ for the EU regulations. You are only allowed to open the Gateway to access an internal USB connector or (reset) buttons.

For new EMS heat sources like the latest Bosch boilers and heat pumps we recommend using a complete Gateway instead of the EMS interface board together with a random ESP32 development board.
Yes, the EMS interface has a safe to use EMS circuit which also bears the CE mark, but you are still connecting various cables and a probably inferior power supply to the board. So it will probably work but you have to be extra careful not to introduce noise or other signals or disturbances to the system. An EMS Gateway is plug and play and fully designed and tested to prevent such noise.

Firmware disclaimer

Wherever firmware is loaded onto the microcontroller, please refer to the specific Github repository of the code for more information on its use and which licenses apply.

The firmware version installed is a recent stable version or a better beta version. You can update to new firmware via the web interface.

Each new hardware version of an EMS Gateway is always designed for the future so you get several firmware updates over time. However, at some point the amount of features and the size of the firmware will become incompatible with your ‘old’ EMS Gateway. We cannot ensure you will be able to make use of every new firmware feature for ever. At some point the hardware will become incapable of running it (or running it smoothly). In that case we do offer a discount on the latest EMS Gateway model on request.
However the current S3 and E32 V2 models have such an overly large RAM and Flash memory that we expect to be able to run all updates on these platforms for years to come. Support for protocols like Modbus are under development and those can be added to the E32 V2 as a firmware update.

Gateway EMS-ESP firmware information

The EMS-ESP firmware loaded onto every Gateway is the great open source project of Proddy and MichaelDvP.
The software license is GNU Lesser General Public License v3.0

The EMS-ESP firmware is needed by the EMS Gateway hardware platform to do it’s magic. Because it is open source, we have been able to add a huge amount of EMS devices and features to the firmware, which would not have been possible otherwise. The BBQKees products are built specifically for the EMS-ESP firmware and the firmware is also tailored to the BBQKees products.
A part of the revenue of each product sold will go towards the development of EMS-ESP.

Gateway disclaimer

Each Gateway is tested individually on an actual EMS boiler.
The Gateway as delivered will be able to send and receive to the EMS bus. Support for specific EMS bus devices like boilers, heat pumps and thermostats is firmware dependent.
The Gateways are guaranteed to work as tested with the standard EMS bus with the firmware as delivered.
Further firmware updates are on your own risk.
The EMS Gateway products provide an interface between the EMS heat source and a home automation system. Support for EMS Gateway products are also limited to this. Any heating or other control strategy on f.i. the home automation is outside of this scope. It is your own responsibility and risk to communicate with the EMS heat source.

Interface board disclaimer

The use of the generic EMS Interface boards is at your own risk. There are many ways to connect such a board in the right way, and also a lot of ways to do this incorrectly.
The interface board V3.1 bears the CE mark, meaning it complies with all EU regulations. It is designed to provide a reasonably safe way to connect a microcontroller to an EMS bus. But of course if you touch or put mains voltage on the interface board this will damage both the interface board and possibly the heat source as well.
However, when you connect anything to this board you may introduce signals, noise or other electrical surges that fall outside of these regulations. Some microcontroller development boards and cheap power supply may introduce more noise into the system than is legal under the EU regulations.
It is your own responsibility to use the EMS interface board correctly and take care of which other electronic devices are connected to it. Any damage to property or living beings that may occur by using anything other than the EMS interface board is at your own risk and not our liability.

The development of all products in this store rely solely on public information and open source efforts of the internet community and not on any official documentation from Bosch.

BBQKees Electronics B.V. is not affiliated in any way with Bosch or it’s other subsidiary brands and associated companies.

BBQKees Quality Tested logoGreat care has been taken that the EMS products act a a good ‘neighbor’ on the EMS bus by thoughtful and professional electronics design and that they do not interfere in any way with the original Bosch control methodology.
Cables and accessories are mostly over engineered to provide you with the best possible safe use case. All cables have pure copper cores with larger core diameters than is needed for minimal operation.
The ABS plastic enclosures have a special fire retardant additive so when exposed to a flame they will self-extinguish to a certain point and only melt.
Furthermore we take pride in good electronics design without reverting to cheaper or inferior parts. It’s just not our mindset to sell an inferior product if we know we could have designed them better for a little more cost. All electronic products have been tested on their RF (Radio Frequent) behavior to make sure they comply to EU regulations.

Payment terms

Unless agreed otherwise, all payments must be made in full in advance. During checkout there are various payment methods to choose from depending on the country of delivery. Our payment processor is Mollie.
Most payment methods provide an instant payment like iDeal, PayPal etc. When you choose the IBAN bank transfer it may take a few days before the payment has been processed. In all cases products are shipped only when the payment has been received in full or as agreed. We reserve the right to cancel any order before shipment. If we cancel an order we will refund the amount to the customer via the payment method of the original payment.

For B2B sales and other sales where exceptions are made such as payment on account/invoice basis our payment terms are 30 days net (from the invoice date).

VAT/BTW

Wherever required, amounts are including the Dutch VAT rate of 21% (BTW) for the Netherlands and all territories outside of the EU, OR charged with the VAT rate of the shipping destination when it is in the EU. This is an EU requirement (OSS). The final price is including taxes wherever required.
For Switzerland we can do VAT free sales on request. However you need to declare the tax yourself at the post office.
Contact us before any purchase.
For the UK most orders stay below the VAT threshold so they will likely pass through customs without additional fees.

If you are a business outside the Netherlands but inside the EU, you can make use of the 0% VAT intracommunity supply arrangement. Please enter a valid VAT number in the checkout. we cannot refund VAT afterwards, not can we change the billing address after the sale has gone through.

Shipping

In the summer months or other low volume periods our local shipping partner picks up the packages twice a week. Usually on Monday and Friday.
In the other months packages are picked up three times a week. Usually on Monday, Wednesday and Friday. An order placed on a specific day before 20:00 will be shipped the next pickup day. So if you place an order on Saturday, this will be shipped on Monday and an order placed on Sunday 23:00 will likely be shipped on Wednesday.
On public or other holidays there will be no pickup of packages.
Sometimes it may happen a shipment is delayed or processed later than our goal of 2 working days. During staff holidays shipments may be deferred to a later date. If so. this is mentioned on the website when you place an order.

On our Shipping page you can find an indication of the shipping cost and transit time of shipping to your destination.
For all areas outside of the EU you may have to pay additional duties, VAT and other import taxes/fees. These additional costs are to be paid by you. We cannot be held reliable for any such costs.

Warranty and returns

All online sales to private consumers in the EU fall under the appropriate EU regulations. We extend these same warranty conditions to Liechtenstein, Norway, Switzerland and the UK.
All BBQKees Electronics products are covered by a two-year warranty. The warranty starts on the date of invoice, or if later from the date of receipt of the products (if this can be verified). Products that are returned for any reason will be checked and tested to see if they are undamaged and in full working order. A refund is then issued via the payment method of the original purchase. We try to test and process the refund within 14 days after receiving the returned product but in some cases this may be extended to 30 days.
We reserve the right to refuse, or lower the amount of refunds for returns that are clearly damaged by the client or transport. However we do not have restocking or other fees. If an order is returned but not all products belonging to that order are received we reserve the right to exclude the purchase price or value of these individual components from the refund. (For instance you buy a KIT but you return it without the power supply. Your refund will then be the KIT price minus the selling price of the individual power supply).

Return shipping of products is at your own expense and risk. If returned packages have duties or other fees to be paid by the recipient, we will refuse the package if they are not paid by the sender.

Applicability

For all agreements and legal relationships to which seller is a party, only Dutch law applies even if a contract is wholly or partially executed abroad or if the legal relationship is with a party (customer) domiciled there.

About our privacy policy

BBQKees Electronics cares greatly about your privacy. We exclusively process data that we need for (improving) our services, and carefully handle all information gathered about you and your usage of our services. Your data is not shared with third parties for commercial goals. This privacy policy applies to the use of the website and the services provided by BBQKees Electronics. The starting date for the validity of these terms and conditions is 30/12/2019, with the publication of a new version the validity of all previous versions is canceled. This privacy policy describes what information about you is collected by us, what this data is used for and with whom and under what conditions this data could be shared with third parties. We also explain to you how we store your data, how we protect your data against misuse and what rights you have regarding the personal data you provide us. If you have any questions about our privacy policy, please contact our privacy contact person, you will find on the contact page.

About our dataprocessing

Below you can read how we process your data, where we save it, what security techniques we use and to whom the data is visible.

Webshopsoftware

We use webhosting and email services provided by Transip. Personal data gathered with the use of our website and services is shared with Transip.nl requires access to these details to offer (technical) support. They will not use this data for any other purposes. Transip.nl has an obligation, based on the agreement we have with them, to take necessary precautions and security measures when it comes to your personal data. We host our webshop on a server under own management. We have taken necessary precautions and security measures when it comes to your personal data such as an SSL-encryption and a strong password policy.

E-mail and mailinglists

For our regular business email, we use the email services of Gmail and our webhost. This party has implemented fitting technical and organisational measures to prevent misuse, loss or corruption of your data. My webhost does not have access to our mailbox and we treat our email-traffic confidentially.

Payment processors (Mollie)

For concluding and processing (part of) our payments in our webshop we use the payment provider Mollie. Mollie processes your name, address and residence information. They also process payment information such as your bank account number or credit card number. Mollie has implemented fitting technical and organisational measures to protect your personal data. Mollie retains the right to use your personal (anonymized) information to further improve their services and, within this context, share it with third parties. All the aforementioned guarantees in regard to the protection of your personal data are also applicable to any services by Mollie that uses third parties. Mollie does not store your data any longer than the installments permitted by the appropriate legal grounds.

Transport and logistics (PostNL)

If you place an order with us it is our responsibility to have your order successfully delivered to you. For the delivery we use the services of PostNL. For a successful delivery it is important that we share you name, address and residential details with PostNL. PostNL uses this information with the sole purpose to carry out the agreement of delivery. In case of PostNL hiring subcontractors, they will share said information with these parties.

Transport and logistics (DHL)

If you place an order with us it is our responsibility to have your order successfully delivered to you. For the delivery we use the services of DHL. For a successful delivery it is important that we share you name, address and residential details with DHL. DHL uses this information with the sole purpose to carry out the agreement of delivery. In case of DHL hiring subcontractors, they will share said information with these parties.

Purpose of data processing

General purpose of data processing

We use your data with the sole purpose of providing you with our services. This means that the goal of processing this data stands in direct relation to the assignment or task that you offer us. We do not use this data for (addressed) marketing purposes. If you share information with us and we use this information to – not based on a request – contact you at a later time, we will first ask for explicit consent. Your data is not shared with third parties, with any other purpose than to fulfil accountancy and administrative obligations. These third parties are all obligated to a duty of confidentiality based on the agreement we have with them, an oath or legal obligation.
You will never ever receive uninvited news letters. We hate that too! We will also not call you on any phone number provided during checkout. That phone number is for the package delivery in case delivery issues.
We do sometimes use our business Whatsapp to send you a message if your order details are incomplete.

Automatically collected data

Information automatically gathered by our website is processed with the sole purpose of providing you with and/or to further improve our services. This information (for instance your IP address (anonymised), web browser and operating system) is not personal information.
Cooperation in tax and criminal investigation In some cases, we may be obligated by government to a lawful duty of sharing your information with the purpose of assisting in a fiscal or criminal investigation. In such cases we are forced to comply and assist, but will, based on lawful possibilities, offer objection.

Retention periods

We store your data for as long as you are a client with us. This means that we maintain and keep your client profile until you make it known to us that you no longer desire to use our services. Such a message also functions as a request to be forgotten. We are required to keep invoices with your (personal) information due to relevant administrative obligations, this information is safely stored for as long as the relevant term for these obligations has not yet passed. Personnel no longer has access to your client profile and any documents made because of your assignment or task.

Your rights

Based on valid Dutch and European law you, as a concerning party, have certain rights when it comes to personal data that is processed by or on behalf of us. Below you may find an explanation of these rights and how you, as a concerning party, can invoke these rights. In principle to prevent abuse we only send invoices and copies of your data to e-mail addresses that you have made known to us. Should you wish to receive this data on another e-mail address or for instance per mail we will ask you to identify yourself accordingly. We maintain an administration of concluded requests, in case of a request to be forgotten we will maintain an administration of anonymised data. You receive all invoices and copies of data in files that are structured in a machine-readable format Based on data classifications that we use within our system.
At all times you maintain the right to lodge a complaint with Autoriteit Persoonsgegevens if you suspect that we mistreat or misuse your personal data.

Right of inspection

At all times you maintain the right to view the data we process that has a relation or may be reducible to your person. You may request such a viewing to our contact in charge of privacy matters. You will receive a response to your request within 30 days. If your request is approved we will send you, via the e-mail address known to us, a copy of all data with an added overview of processors managing this data while also mentioning the categories under which we store this data.

Right to rectification

At all times you maintain the right to have the data we process that has a relation or may be reducible to your person be adjusted. You may request such an adjustment to our contact in charge of privacy matters. You will receive a response to your request within 30 days. If your request is approved we will send you, via the e-mail address known to us, a confirmation that the data has been adjusted.

Right to restriction of processing

At all times you maintain the right to limit the data we process that has a relation or may be reducible to your person. You may request such limiting to our contact in charge of privacy matters. You will receive a response to your request within 30 days. If your request is approved we will send you, via the e-mail address known to us, a confirmation that the processing of your data is limited until you chose to cancel said limitation.

Right of transferability

At all times you maintain the right to request for the data we process that has a relation or may be reducible to your person be processed by a third party of choice. You may send in such a request to our contact in charge of privacy matters. You will receive a response to your request within 30 days. If your request is approved we will send you, via the e-mail address known to us, your (personal) invoices or copies of data that we, or third parties on behalf of us, have processed. It is highly likely that in such a case we can no longer offer our services to you for we can no longer guarantee the previous data safety.

Right of objection and other rights

At all times you maintain the right to object to the processing done by us, or on behalf of us by third parties, of your personal data. In case of such an objection we will immediately cease all processing of your data while your objection is being investigated and handled. In case of a justified objection we will return all invoices and/or copies of personal data that we, or third parties on behalf of us, have processed up until that point and cease processing thereafter. You also maintain the right to not be subject of automated decision-making processes or profiling. We process your data in such a way that this right does not apply. Should you believe that this right does apply then we ask you to reach out to our contact in charge of privacy matters.

Privacy policy changes

At all times we maintain the right to alter our privacy policy. This page however always displays the most recent version of our privacy policy. Should a new privacy policy have consequences for the ways in which we process recently gathered data in regard to your person, then we will notify you of this via e-mail.

Final Conditions

These terms and conditions may be translated manually or by machine to other languages. In case of any incorrect translation or other ambiguity/interpretations, this English version is the leading document.
